Do I need a licence to publish a video (DVD, BLU-RAY)?

To distribute a video, whether free of charge or for a price, an SGAE licence is required for the reproduction and distribution rights.

What steps do I need to take to publish a video (DVD, BLU-RAY)?

Just complete an authorization contract that varies depending on the characteristics of your production, to which we will apply the SGAE's general tables of fees for reproduction and distribution rights on videographic media.

Examples of fees

• For videos (DVD, BLU-RAY) distributed together with newspapers or magazines, the following text must appear: "Copy distributed with a printed or graphic publication".
• Videos covered by this licence are not allowed to include advertising about any person or company other than the videographic company or the printed publication with which the videos are distributed.
• Payment of copyright: you can opt between:
1. Payment based on the units manufactured.
2. Payment based on the units sold. In this case, payment will be made for 50% of the units manufactured with the obligation to inform the SGAE within the next 70 days following publication of the total units sold out of the remaining 50%.

What does this licence include?

Video (DVD, BLU-RAY)
Whenever you want to distribute a video with these characteristics: Feature film, documentary, work adapted for TV, dramatic works and karaoke videos, the procedure for applying for a licence is as follows:

• Complete the authorization contract

• The SGAE identifies the repertoire used (Direction, Script and Music)

• The SGAE issues a licence (invoice) by applying the general tables of fees for this type of production

• The video can be distributed once the invoice from the SGAE has been paid

Deductions and rate reductions

The deductions for the fees are as follows:

• 7,5% when using the recommended retail price

• 10% when using the retailer's cost price

FAQ's

To market a video (DVD, BLU-RAY), is it necessary to be a videographic producer?
No. Any private individual or body corporate can market a video by completing the SGAE authorization agreement and paying for the corresponding licence.
What is the Distribution right?
This is the power to decide on whether to make the original or copies of the work available to the public through its sale, rental, loan or any other means. The delivery of copies of physical media containing works in the SGAE repertoire to a store for sale to consumers constitutes distribution.
I already pay to include music in my video; why do I have to pay the SGAE?
What you paid to the registered holder of the music is the synchronization fee (the possibility to include a musical work in an audio-visual). When you make copies, the right to the Distribution fee is generated.
